    Customs Impact on Shared Services Design

    Supply chain studies show that logistics-management- IT, and/or general administrative functions can often be optimized. Restructuring typically results centralizing such functions in a HQ entity, a technology center and/or a shared services center.

    Frequently, also full-blown buy/sell entities are converted into sales agents, commissionaires or Limited Risk Distributors. At the same time, full-blown manufacturers may also be converted into consignment- or contract manufacturers.

    Especially, when supply chain optimization results in the shifting of functions, activities and/or risks from EU to non-EU, this could have a significant impact on the customs function.

    Any Customs Issues?

    • If key functions are shifted to non-EU, there may be an impact on the customs value, the classification and the origin of the goods and also on existing customs licenses.
    • If the HQ functions and administration are located in non-EU (e.g. Switzerland), it may not be possible to obtain a Single European customs license (see also under topic SASP), for customs related activities (still) undertaken in the various EU member states.
    • Problems may occur with respect to obtaining AEO status (S&S and simplified arrangements; see also under topic AEO)
